Criminal tax law
Exempting voluntary disclosure
Tax evasion is punishable as a criminal offense with a fine or prison sentence of six months to five years, in serious cases up to 10 years. The tax office does not hesitate for long and initiates criminal proceedings through the Fines and Criminal Matters Office. We support you within the scope of legal admissibility in criminal proceedings and primarily prepare the tax documents that are necessary for the proceedings to be discontinued.
In cases where it is necessary to consult a lawyer, we work together with a nationwide network of experienced criminal defense lawyers. If criminal proceedings are opened, please do not hesitate to contact us. Under no circumstances should you submit declarations without consulting a tax expert.
Before criminal proceedings are initiated, German tax law offers the possibility of returning to tax honesty and thus remaining unpunished by means of a voluntary declaration exempting the taxpayer from prosecution. The conditions for impunity should not be underestimated. The road to the goal is long, complicated and expensive. Nevertheless, if you have evidence that not everything was explained as it should have been in the past, you should definitely take action. The density of controls and the probability of detection have been increasing considerably for years and the damage in the event of a conviction for tax evasion is extremely high in most cases.
We will be happy to discuss the individual requirements, including the necessary payments, with you in person. It is possible to find a way out of a situation with problematic tax evasion. Please contact us.
